We recognize that our students and clients join us from around the world. Nothing in these Terms is intended to limit or exclude any mandatory consumer protection rights you may have under the laws of your local jurisdiction (such as GDPR protections for EU residents or CCPA for California residents) that cannot be waived by contract.
5.3 Dispute Resolution Strategy
To ensure a fair and efficient resolution process for a worldwide audience, we follow a tiered approach to disagreements:
Informal Resolution: We first seek to resolve any concerns through direct, good-faith negotiation. Most issues regarding AI coaching or course access can be settled with a quick conversation.
Online Mediation: If an informal resolution isn't reached, both parties agree to explore Online Dispute Resolution (ODR) or virtual mediation. This avoids the logistical burden and high cost of international travel for either party.
Arbitration & Jurisdiction: As a final resort, any formal legal proceedings shall be subject to the non-exclusive jurisdiction of the courts of Malaysia. However, if mandatory local laws in your country require a different venue for consumer disputes, we will respect those jurisdictional requirements.
5.4 Severability
If any part of these Terms is found to be unenforceable in a specific country, that part will be modified to reflect the parties' intention, and the rest of the agreement will remain in full force and effect.
